Supreme Court Issues Stern Warning to High Courts: Expedite Bail Hearings or Face Consequences
In a resounding declaration, the Supreme Court has issued a stark warning to High Courts across the nation, urging immediate action to streamline and accelerate the processing of bail applications. Justices C.T. Ravikumar and Sanjay Kumar expressed deep concern over the persistent delays in considering both anticipatory and regular bail pleas, despite prior judicial directives.
Following a pivotal ruling in April 2023, where the apex court emphasized that prolonged trial delays could warrant bail, even under stringent laws like the NDPS Act of 1985, the Supreme Court escalated its directives. In a recent December 2023 mandate, the Court vehemently directed High Courts to prioritize and expedite bail applications’ hearings.
Emphasizing the pivotal nature of timely bail consideration, the Supreme Court underscored the potential infringement on individuals’ liberty due to prolonged delays. Furthermore, the Court unequivocally stated that once bail entitlement is established, any limitations on its duration are impermissible.
