That on 07.06.2014 drug Inspector Sunny Kaushal
alongwith police personals viz. ASI Harjeet Singh, Constable Anil
Kumar PP Daulatpur visited the premises of M/S Chaudhary
Nursing Home situated at VPO Marwari Tehsil Amb Distt. Una
H.P. and found that Ashwani Kumar S/O Harbans Singh VPO
Marwari Tehsil Amb Distt. Una was physically running a shop and
when they entered the shop Drug Inspector Sunny Kaushal disclosed his identity and found that the proprietor of firm i.e. Ashwani Kumar had stocked and displayed the huge quantity of drugs/medicines.
On enquiry by the Drug Inspector asked Ashwani Kumar to produce the license or any permit for drugs/medicines which were diplayed by him in his shop.
Accordingly on non production of any license or permit for sale of
drugs or possession of drugs the case u/s 18C read with section
27(B) (II) and section 18A read with section 28 was made out
against the accused.
Accordingly the trial against the accused was conducted before the Court of Ld. Additional Sessions Judge-I Una.
The prosecution has examined six witnesses to prove the case.
Thereafter, the court of Ld. Additional Sessions
Judge-I Una Sh. Krishan Kumar held the accused guilty and
sentence him u/s 18C for imprisonment of one year and fine of Rs. 5000/- and in default of payment of fine of Rs. 5000/-
imprisonment of three months and u/s18A of Drugs and Cosmetic
Act 1940 for imprisonment of one year and fine of Rs. 1000/- and
in default of payment of fine of Rs. 1000/-imprisonment of three
months.
