The Supreme Court has taken up the case of six rebel Congress MLAs from Himachal Pradesh who were disqualified by the Speaker of the Himachal Pradesh Assembly, Kuldeep Singh Pathania. The MLAs, namely Rajinder Rana, Sudhir Sharma, Inder Dutt Lakhanpal, Devinder Kumar Bhutoo, Ravi Thakur, and Chetanya Sharma, found themselves at the center of a political storm after abstaining from a crucial budget vote and cross-voting in favor of the BJP candidate during the Rajya Sabha elections.

Initially, the Supreme Court questioned why the disqualified MLAs had not sought relief from the High Court. However, it has now agreed to hear their case on the upcoming Monday, indicating a willingness to delve into the complex legal and political dynamics surrounding their disqualification.

The disqualification of these MLAs came as a result of Speaker Kuldeep Singh Pathania invoking the Anti-Defection law, a move aimed at curbing what he termed ‘Aya Ram gaya Ram’ politics, a phrase harkening back to the 1960s when defections by political leaders were rampant and used to destabilize elected governments.

The six MLAs moved swiftly to challenge their disqualification in the apex court through their representative, Chetanya Sharma, who filed a petition against the Speaker’s decision on February 29. The urgency of the matter was highlighted by Senior Advocate Satya Pal Jain, who requested an adjournment due to the absence of Senior Advocate Harish Salve, leading the case, and emphasized the rarity of MLAs being disqualified within a span of 18 hours.

In terms of the political landscape, the disqualification has significantly altered the composition of the Himachal Pradesh Assembly. With the effective strength of the House reduced from 68 to 62, and the number of Congress MLAs shrinking from 40 to 34, the political balance has shifted, potentially impacting future legislative decisions and the stability of the government.

This development adds another layer to the already complex political dynamics in Himachal Pradesh, with implications that extend beyond the fate of the six disqualified MLAs. As the Supreme Court prepares to hear their case, the outcome could have far-reaching consequences for both the individuals involved and the broader political landscape of the state.
